1. Agreement to Terms

By downloading, installing, or using the Virtuset mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Use of AI Technology

Virtuset utilizes Artificial Intelligence (Google Gemini API) to generate images based on your text prompts and uploaded reference photos.

• No Guarantee of Uniqueness: Due to the nature of AI, similar prompts may result in similar images. You acknowledge that generated content may not be unique.
• Accuracy & Suitability: AI may produce artifacts, errors, or content that does not align with your intent. We are not liable for the quality or accuracy of generated images.
• Copyright: Subject to Google's API terms, you own the rights to the images you generate, provided you have the rights to the input data used.

3. User Content & Conduct

You are responsible for the content you upload (reference photos) and the text prompts you enter.

• You represent that you own or have permission to use any photos you upload.
• You agree NOT to generate content that is: illegal, hateful, explicit, violent, or infringes on the intellectual property rights of others.
• We reserve the right to ban users who use the service to generate harmful or objectionable content.

4. Virtual Credits & Subscriptions

Virtuset operates on a virtual currency system ("Credits").

• No Monetary Value: Credits have no real-world monetary value and cannot be exchanged for cash.
• Consumable Packs: One-time credit purchases (e.g., "Pouch", "Sack") do not expire as long as your account remains active.
• Subscriptions: "Weekly" and "Monthly" subscriptions provide a specific allowance of credits per cycle. Unused subscription credits may not roll over depending on the specific plan terms displayed at purchase.
• Refunds: All purchases are processed by Apple. We cannot issue refunds directly. Refund requests must be made to Apple Support.

5. Intellectual Property

The Virtuset App, including its code, design, and interface, is the property of the Developer. You are granted a limited, non-exclusive, non-transferable license to use the App for personal use.

6. Disclaimer of Warranties

The App is provided "AS IS" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that AI generation will always be available (e.g., during API outages).

7. Limitation of Liability

To the maximum extent permitted by law, Virtuset shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App or inability to access your generated content.

8. Apple Device Terms

You acknowledge that these Terms are between you and Virtuset, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services.

9. Changes to Terms

We modify these terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.
